In 2015, the major critical care societies issued guidelines outlining a procedural approach to resolving intractable conflict between healthcare professionals and surrogates over life-sustaining treatments (LST). We report our experience with a resolving conflict procedure. This was a retrospective, single-centre cohort study of ethics consultations involving intractable conflict over LST. The resolving conflict process was initiated eleven times for ten patients over 2,015 ethics consultations from 2000 to 2020. In all cases, the ethics committee recommended withdrawal of the contested LST. (...) In seven cases, the patient died or was transferred or a legal injunction was obtained before completion of the process. In the four cases in which LST was withdrawn, the time from ethics consultation to withdrawal of LST was 24.8 ± 12.2 days. Healthcare provider and surrogate were often distressed during the process, sometimes resulting in escalation of conflict and legal action. In some cases, however, surrogates appeared relieved that they did not have to make the final decision regarding LST. Challenges regarding implementation included the time needed for process completion and limited usefulness in emergent situations. Although it is feasible to implement a due process approach to conflict over LST, there are factors that limit the procedure’s usefulness. (shrink)

Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes on organizational (...) members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Introduction Included in a collection of manuscripts and early printed books recently acquired by the Library of the University of California, Los Angeles, from the Paris bookdealer Paul Jammes ~ are three manuscripts attributed to a certain Nicolas de la Toison, Baron de Bussy. Two of the three volumes contain extensive Latin commentaries on the major writings of Aristotle.2 The third is a miscellaneous volume written in three different hands, which contains, among other things, a complete French translation of the extant writings of Sextus Empiricus (c. It is traditionally believed that cerebral activation (the presence of low voltage fast electrical activity in the neocortex and rhythmical slow activity in the hippocampus) is correlated with arousal, while deactivation (the presence of large amplitude irregular slow waves or spindles in both the neocortex and the hippocampus) is correlated with sleep or coma. However, since there are many exceptions, these generalizations have only limited validity. Activated patterns occur in normal sleep (active or paradoxical sleep) and during states of anesthesia (...) and coma. Deactivated patterns occur, at times, during normal waking, or during behavior in awake animals treated with atropinic drugs. Also, the fact that patterns characteristic of sleep, arousal, and waking behavior continue in decorticate animals indicates that reticulo-cortical mechanisms are not essential for these aspects of behavior. These are contrasted with the proof theory of Fregean Predicate Logic, and the traditional (extensional) choice function semantics for the calculus. The semantics provided show that epsilon terms are referring terms in Donnellan's sense, enabling the symbolisation and validation of argument forms involving E-type pronouns, both in extensional and intensional contexts. By providing for transparency in intensional constructions they support a (...) Model Conceptualism to contrast with traditional intensional logic's Modal Realism. Little attention has been given in medical ethics literature to issues relating to the truthfulness of patients. Beginning with an actual medical case, this paper first explores truth-telling by doctors and patients as related to two prominent models of the physician-patient relationship. Utilizing this discussion and the literature on the truthfulness and accuracy of the information patients convey to doctors, these models are then critically assessed. It is argued that the patient agency (patient autonomy or contractual) model is inherently and (...) seriously flawed in numerous circumstances, even those involving informed and competent adult patients. The generalized thermodynamic potential analysis of nonlinear irreversible processes precludes the analysis of rotational processes. The nonexistence of scalar potential functions necessitates a thermodynamic analysis of the system forces. A field analysis in the phase space of the generalized displacements and velocities treats the force components as tensors of second order that tend to deform and rotate the irreversible process, which is viewed as an elastic material. The analysis of chemical oscillatory processes involves the introduction of the thermodynamic vector potential, (...) which is subsequently used in the formulation of a variational principle and to define an energy flux vector. The direction of energy flow elucidates the mechanism by which steady motion is maintained and it is a characteristic property of open systems. Field analyses of systems that are described by half and single degrees of freedom are contrasted. (shrink)

The paper investigates completions in the context of finitely generated lattice-based varieties of algebras. In particular the structure of canonical extensions in such a variety $${\mathcal {A}}$$ is explored, and the role of the natural extension in providing a realisation of the canonical extension is discussed. The completions considered are Boolean topological algebras with respect to the interval topology, and consequences of this feature for their structure are revealed.
